Louisiana v. Patrick Kennedy

      In 2003, A man named Patrick Kennedy raped his step-daughter. The girl originally said that 2 boys had assaulted her in her garage. 21 moths later she reported what actually happened. The assault took place when she was sorting her Girl Scout Cookies in front of her garage.

     Kennedy is currently on death row.  Under Lousiana law, a rape of a child that us under the age of 12 can be put on death row. He is the first and only person on death row for rape that didn’t include murder. The supreme court will decide whether or not keep him on death row in April. This case ties in with the 8th amendment because  cruel and unusual punishment or bail isn’t needed because Kennedy is on death row.

     I am in favor of him being on death row because the girl was only 8 years old! this can scar her for the rest of her life and maybe even cause her to do bad things later on.

    I agree that the guys should be on death row. it is not right for the girl to remember the bad thing that happend in her life. The girl is still a minor under the age of 12. I don’t really think that his punishment is cruel and unusual punishment.

    I think that the Supreme Court made the right decision to put Patrick Kennedy on a death row for what he did. In my opinion, he should have more consequences for what he did because the girl was 8 years old. Instead of Patrick Kennedy being a role model, he has set a bad example for his step-daughter. That is my opinion. -Eduardo-

    i believe that Patrick kennedy got what he deserved for doing such a horrific crime to an 8 year old, not to mention his own step-daughter

    I think that what estuardo pointed was true just because
    the girl was very young at the age she was raped.
    Specially she was raped by her own step - father.
    and according the 8th amendment, this act
    WAS cruel & unusual punishment so he
    has the rights to be in death row.

    I think that Patrick Kennedy got what he deserved, for doing such a horrific and brutal crime to an 8 year-old, not to mention this was his step-daughter. And not to mention this girl might now be hurt psychologically, after someone doing such a thing to her at a very young age.

    I think that the man should remain on deathrow because what he did was a very serious crime and shouldnt be taken lightly. If he is just let go then he will most likely just go back to his old ways.

    hey esty it is kimmy..
    it was really interesting reading about this case for the name caught my attention. I can’t believe that a father would actually do that to a girl let alone his daughter, that is really not cool. I actually agree with you that he should be in death row for doing that, but i disagree on having him be pending if he is going to be on death row or not. I think he should automatically get punished and not wait., because that is really terrible knowing some girl was abused. I also agree that that will scar her for life. …..what a terrible thing to under go ……
